The Australian Constitution is the set of rules by which Australia is run. It is the highest law of the land and established the rules for our ongoing democratic Australian Government.
The Constitution can only be changed with the approval of the Australian people. A proposed change must be approved by the Parliament and then be voted on by Australians in a referendum.
A short overview of the history of Constitution Day and how our national system of government was formed can be found here.
Does the constitution protect the rights of Aboriginal and Tores Strait Islander peoples?
Yes. An overwhelming majority of Australians voted ‘yes’ in the 1967 referendum, creating constitutional equality for all Australians.
Since 1967, every Australian, regardless of race, has been recognised as equal before the law.
That could change in 2023.
The establishment of an Aboriginal and Torres Strait Islander Voice in the constitution will write racial division into our most important legal document.
